We have a footprint in several African jurisdictions experiencing unprecedented infrastructural development. Most of our lawyers are recognized as leaders in their jurisdictions by international directories such as Chambers Global, Legal 500 and IFLR. For instance, Amyn Mussa, one of the co-heads of the sector group is described by Chambers Global as “one of the leading guys in energy work in Kenya”.
Our sector group has been involved in landmark deals on the continent. We were involved in Botswana’s largest energy project; Botswana Power Corporation’s US$ 16 billion integrated Mmamabula Energy project and we also handled Zambia’s US$1.5 billion Kafue Gorge Dam construction project.
We stand out from other networks due to our “one-firm” approach to cross border deals. Our lawyers work in virtual teams across multiple offices to not only offer seamless legal advisory and transactional services for cross-border deals, but also to take advantage of cross-border training and other opportunities to build the network’s resources.
Our seamless advice extends to billing and training. Through this collaborative approach, our sector group is able to handle complex multi-jurisdictional matters.
Our sector group is selected for many ground-breaking deals. We drafted the first wind PPA in Kenya (Turkana Wind Power Project); completed the Triumph Power Project, which was the first time a Chinese commercial bank used MIGA cover for a non-recourse transaction; advised on the first undersea fibre optic cable project linking Kenya to UAE; and were legal advisors in the first Ugandan roads PPP (Kampala-Jinja expressway).
Our sector experts have 180 years of cumulative experience in handling large Energy and Infrastructure projects exclusively on the continent and have strong business and regulatory relationships in each jurisdiction which means that they have a good understanding of how to structure a deal in light of potential political risks. In 2013 alone, we handled 10 large Energy and Infrastructure projects.
We have worked on several project financing agreements with unique government lenders and multi-lateral agencies such as AfDB, EADB, Africa Infrastructure Fund, PTA Bank, Nedbank, FMO, DEG, EXIM bank, MIGA, IDA, International Finance Corporation and European Investment Bank.
We have experience advising on legal matters related to project structuring and development, financing, government regulation, construction and other contract issues. Our expertise covers:
