  • Acting for South African Allied Technologies (Altech) on 2008’s largest information technology acquisition in Kenya, Altech’s acquisition of a controlling stake in each of Kenya Data Networks, a leading Kenyan digital communications operator, Swift Global, a leading internet service provider in Kenya and Tanzania, and Infocom, a Ugandan broadband and internet services provider, including conducting due diligence and advising on competition, telecommunications and other regulatory matters.
  • Acting for Avaya Communications, a privately held telecommunications company previously listed on the New York Stock Exchange, in connection with its establishment of operations in sixteen African jurisdictions pursuant to Avaya’s five year outsourcing engagement by Bharti Airtel, including advising on telecommunication licensing and related regulatory matters in Kenya, Nigeria, Zambia, Tanzania and Ghana.

  • Acting for Bharti Airtel, the largest cellular service provider in India, on the acquisition of Zain’s mobile service providers across fifteen countries throughout the Middle East and Africa, advising on the transaction in Kenya, Tanzania, Uganda and Zambia including obtaining clearance from relevant telecommunication and competition authorities in each country.
  • Advising The East African Marine System (TEAMS), a consortium of East African national and international telecoms service providers and the Government of Kenya, on the construction, operation and maintenance of an under-sea fibre optic cable providing telecommunication services between Mombasa, Kenya and Fujairah, UAE, including drafting and reviewing subscription, loan, shareholding and capacity agreements, advising on corporate and tax structures, telecommunications, PPP law and other relevant regulatory schemes and reviewing and advising on the construction and maintenance agreement between TEAMS and Emirates Telecommunications (Etisalat) and the supply contract between Alcatel, TEAMS and Etisalat.
  • Acting for Essar Telecom Kenya, subsidiary of Indian conglomerate Essar Global, on its acquisition of a Kenyan mobile service provider from Econet Wireless through and including Essar’s subsequent sale six years later to Safaricom and Airtel which consolidated the local market from four to three mobile service providers; A&K drafted and negotiated all purchase and sale documentation, obtained regulatory clearances for the transactions from the Kenya Communications Authority, the Competition Authority of Kenya, the Kenya Civil Aviation Authority, and the National Environmental Management Authority, as well as provided ongoing corporate, employment, tax and regulatory advice during the years between Essar’s purchase and sale.
  • Advising Google Inc., an American multinational technology company specializing in Internet-related services and products, in connection to the legality of their global anti-harassment policy, including providing legal advice on the law on sexual harassment in Kenya and reviewing Google’s Global Anti-harassment policy to ensure that it is in line with the Kenyan law.
  • Acting for CCTV, the major state television broadcaster in mainland China, and its parent company Bright Vision Media, in connection with employee related matters such as   termination of employees on various grounds, including drafting pieces of advice, drafting warning letters or termination letters depending on the severity of the matters involved, advising on matters related to redundancy payments, and attending to disciplinary hearing regarding termination of employees.
  • Acting for Ericsson, a leading provider of telecommunications equipment and related services to mobile and fixed network operators globally, on the entire rollout for Econet Wireless Kenya Limited (the fourth mobile operator in Kenya) and Telkom Kenya Limited (the former sole fixed line operator).
  • Advising Tata Communications, a leading global provider of telecommunication products and listed on the Bombay Stock Exchange and the National Stock Exchange of India, on telecommunication regulation and licensing requirements in Kenya and several other African jurisdictions for purposes of its operations, including advising on, and liaising with, the relevant regulators in Kenya, Tanzania, Angola, Nigeria, DRC, Ivory Coast, Mauritius.
  • Acting for Seacom in connection with the East African portion of its development of the USD 650 million, 17,000 kilometre, undersea fibre optic cable stretching from India to France through Mozambique, Madagascar, Kenya and Tanzania, including advising on Landing Station Lease Agreements, the selling of IRUs (Indefeasible Rights of Use) and option agreements.
  • Acting for Econet Wireless on its acquisition of Telecel Globe and its subsidiaries U-Com Burundi and TelecelCentralafrique mobile operators in Burundi and Central African Republic respectively, from Global Telecom, a subsidiary of VimpleCom, one of the world’s largest telecom operators.
