ACT OF PARLIAMENT:

A document that sets out legal rules enacted by Parliament and assented to by the President. Also known as Statute.

ACTION:

A civil proceeding in which a person pursues a legal right in court.

Ad Colligenda Bona:

TO COLLECT THE GOODS, A temporary order for the administration of an estate of a deceased person used when the estate is of a perishable nature.

Ad Hoc:

FOR THIS PURPOSE, Ad Hoc decisions are made as and when a situation demands:- Ad Hoc committees are formed to address a particular issue - Ad Hoc meetings would take place to discuss specific matters.

Ad Idem:

OF SAME MIND, ie as one; agreed eg the parties are ad idem on this point.

Ad Infinitum:

WITHOUT LIMIT, Describes an event apparently continuing without end.

Ad Litem:

FOR THE SUIT, Denotes a temporary appointment which continues during legal proceedings ie Guardian Ad Litem.

ADDENDUM

A supplemental section of a document containing material added after the document was prepared. It may be executed simultaneously or at a later time.

ADJOURNED GENERALLY

Temporary suspension of the hearing of a case by order of the court (maybe for an indefinite period of time sine die). See LATIN TERMS

ADJOURNMENT:

The postponement or suspension of the hearing of a case until a future date.

ADMINISTRATOR:

A person appointed by the court to collect and distribute a deceased person’s estate when the deceased died intestate.

ADOPTION:

i) An act by which the rights and duties of the natural parents of a child are extinguished and equivalent rights and duties become vested in the adopter or adopters, to whom the child then stands in all respects as if born to them in marriage.

ii) The process through which a court recognises the decision of a judicial body or tribunal and through which that decision is recognised as the judgement of that court having the force of law and/or binding as such.

ADVERSE POSSESSION:

A person who acquires title to land by squatting on the land of the registered owner through open, hostile and continuous occupation on the land for a prescribed period.

ADVOCATE:

A person whose name is duly entered as an advocate upon the roll kept in accordance with the Advocates Act;

AFFIDAVIT

A written statement of evidence confirmed on oath or by affirmation to be true and taken before someone who has authority to administer it (i.e. a Commissioner for Oaths).

AFFIRMATION:

Declaration by a witness who is a minor or who has no religious belief, or has religious beliefs that prevent him/her taking the oath, that the evidence he/she is giving is the truth.

AGREEMENT FOR LEASE:

A contract to enter into a lease.

ALIEN:

A person who under the laws of a particular state is not a citizen of that state.

ALLOTMENT OF SHARES:

Process of acquiring previously unissued shares in a limited liability company in exchange for a contribution of capital.

ALTERNATIVE DISPUTE

An alternative method by which parties can resolve their dispute without the need of the conventional litigation.

Amicus Curiae:

A FRIEND OF THE COURT, A neutral party who does not represent any individual party in the case who will be asked by the Court to make representations from an independent viewpoint.

ANNUAL RETURN:

A document that registered companies are required by law to annually file with the Registrar of Companies. It sets out the current information on the shareholding, shareholders and directors of the company.

ANNUL:

To declare no longer valid.

Ante:

BEFORE, An indication within text to refer to an earlier passage.

APPEAL:

Application to a higher Court or authority for review of a decision of a lower Court or authority.

APPELLANT:
Person who appeals (ant. Respondent).
ARBITRATION:

A hearing and determination of a dispute by one or more independent persons agreed to by both parties in a contract or legally binding agreement.

ARTICLES OF ASSOCIATION:

The internal regulations of a company which sets out, among other provisions, directors’ duties, powers the way which the transfer of shares is to be handled and quorum for meetings.

ASSIGNMENT:
The transfer of a chose in action (for example, a debt) by one person, the assignor, to another, the assignee
ATTACHMENT OF EARNINGS:

An order that directs an employer of a debtor to deduct regularly an amount, fixed by the court in any event not to exceed a one third of the debtor's earnings and pay that sum into court.

ATTACHMENT:

An order for the detention of a person and/or his property.

AWARD:

Result of an arbitration hearing or the amount of damages assessed by a court
